DATA PROTECTION DECLARATION OF THE COMPANY "DOCADOM SA"
1. General
DOCADOM SA, a company located at Avenue de Béthusy 29, 1004 Lausanne, Canton of Vaud, Switzerland (hereinafter: the "Company") is the operator of the "DOCADOM" application (also available on the website www.docadom.ch, hereinafter: "the Application") and provider of the services offered by this Application.
The User is any person who accesses the DOCADOM application (hereinafter: "the User"). These data protection declarations apply to both the DOCADOM Application and the website www.docadom.ch.
For this reason, DOCADOM SA is responsible for the collection, processing, and use of your data and ensures that its actions comply with Swiss law.
The protection of your personal data is of particular importance to our Company.
Hereby, we inform you of the data that will be collected on our Application as well as the use that will be made of it. You will also learn how to ensure the accuracy of this information as well as the procedure to request the deletion of your data.
By using our Application, you expressly acknowledge that we may process your Personal Data in accordance with this Privacy Policy.
Please note that this Data Protection Declaration may be subject to periodic changes. We therefore recommend that you read this Data Protection Declaration regularly to ensure that you are always aware of the most recent version.
2. Collection, Use and Processing of personal, medical and computer data
2.1 Personal and medical data
" Personal data " means any information concerning an identified or identifiable natural person as defined by Swiss data protection legislation.
" Sensitive data " means, in particular, any information concerning a person's health data or genetic data.
" Data Controller " : the private individual who determines the purposes and means of processing personal data;
" Processor " : the person who processes data in accordance with instructions defining the essential parameters regarding data protection. They act under the authority of the Data Controller and upon their instruction.
The Company acts as Data Controller for Personal Data collected in connection with the use of the Application. The Application will collect personal and sensitive data about you – in particular when making an appointment, in order to be able to inform the Doctor, who will go to the meeting place, about the case to be treated. The collected data is used exclusively for the provision of the medical service. Some of this data may, after irreversible anonymization, be used for research or statistical analysis purposes in accordance with this Statement.
This may include in particular :
Your last name, first name, home address, Email address, telephone number, gender ;
Your insured number ;
Your pathologies and symptoms (sensitive data);
Any sensitive data you may share.
It is possible that access to the Application may not be possible, if you do not wish to communicate the requested information.
2. The Company acts as Processor for the Doctors (who then act as Data Controllers) regarding Personal Data collected in connection with any consultation or follow-up of the Patient.
Doctors will collect your personal and sensitive data – in particular when making an appointment and during the consultation – in order to be able to perform their services diligently like any competent professional in this field. You will be informed by the Doctor responsible for the data of the data being collected. You will be able at any time to obtain information from the Doctor responsible for the data.
This may include in particular:
Your last name, first name, home address, Email address, telephone number, gender ;
Your insured number ;
Your medical and family history ;
Your pathologies ;
Your social environment and lifestyle ;
Any data or information necessary during the medical history to establish a diagnosis ;
Your therapy plan and care plan ;
Your medical file.
3. Whether the Company acts as Data Controller or Processor, it takes the necessary measures to ensure the protection and confidentiality of Personal and sensitive Data held or processed, in compliance with applicable legal provisions.
The Company may collect data and information and keep it either in paper format, or in electronic or computerized format, in particular on its Application.
This data and information will never (except as mentioned in the paragraph below) be transmitted to third parties not working in the medical field except in the event of the express agreement of its patients.
This data and information can only be transmitted to third parties outside the medical service for computer storage reasons (servers, IT companies, etc.). These non-medical third parties must guarantee by separate agreement that this data is not transmitted to third parties or stored outside of Switzerland. In addition, these third parties must undertake by separate agreement to take security measures to guarantee optimal security and confidentiality of this data and information. The Company cannot be held responsible for any failures of its third parties. Any potential claims must be directed specifically against them, to the exclusion of all claims against the Company.
The articles and provisions drafted below (starting from number 2.2) apply exclusively to computer and browsing data, to the exclusion of medical and personal data.
2.2 IT and browsing data
When the User visits the Application, certain IT and browsing data are automatically recorded for system administration, statistical, or security reasons.
This includes in particular:
The name of the User's internet service provider;
The User's IP address;
The version of the User's browser software;
The operating system of the computer with which the User accessed the Website;
The date;
The time ;
The website from which the User accessed the Website ;
The search terms that the User used to find the Website.
The type of mobile phone and/or operating system.
By logging in or registering as a User and entering your data on the Website, you agree that your data will be used in connection with the services offered.
2.3 Partner Doctors' Data:
The Company collects information such as first name, last name, and telephone number of the Doctors. This also makes it possible to inform the Patient of information relating to the Doctor who will carry out the medical visit.
3. Use and purpose of personal data collection
The User’s data is collected and used so that the Company can provide the service as proposed in the general terms and conditions. The Patient must be able to identify themselves and explain their symptoms on the Application, in order for a Doctor to conduct a medical visit. The Doctor’s data is collected and processed by DOCADOM so that the Patient can know which Doctor will come to visit them.
As a responsible organization that respects your privacy, DOCADOM does not process User data to establish a profile about them through a profiling process. The Company does not make decisions with legal effects on Users based exclusively on automated processing (automated individual decision-making).
The Company may combine the User's personal data with other information (aggregate it) or erase any information that allows them to be identified (anonymize them), so that they are no longer considered Personal Data, in which case this privacy policy will no longer apply to this data and the Company may use it for purposes not covered by this Policy (e.g., to produce anonymous statistics on the use of the Company's Services).
In addition to the treatment necessary for the provision of medical services, the Company may use certain Patient data after irreversible anonymization for scientific research, statistical analysis, or service improvement purposes.
This anonymized data does not allow Patients to be identified and is therefore no longer considered personal data under the applicable legislation.
General consent to this use is collected during registration on the Application or the telephone service. The Patient may withdraw this consent at any time, without this affecting their access to medical services.
4. Transmission of personal data:
Your personal data may be transmitted to our partners (third parties) if this is necessary for the provision of the services offered by the Company or for other legitimate reasons. If we transfer your data to external providers, technical and organizational measures will be taken to ensure that these transmissions comply with the legal provisions on data protection. If you provide us with your personal data, we undertake not to use, process or transmit them beyond what is permitted by law or your consent. It is for this reason that we only transmit your data to external providers in case of necessity for the processing of appointments or for storage reasons and if this meets strict requirements of confidentiality and diligence. Beyond these cases, we only transmit your data to third parties in case of legal obligations or in case of injunctions from authorities or courts. You can ask at any time to which partners your data is transmitted.
The data may be transmitted to the Doctor who will visit you, to follow up on the appointment booking on the Application. The Doctor obtains all information relating to your situation, in order to be able to proceed with the medical consultation. The Doctor is solely responsible for processing your Personal Data in the context of treatment or consultation, in accordance with the data protection law. In case of legal necessity, your data may be disclosed by the Company.
5. Data Transfer
Users' personal data is stored in Switzerland.
Users' data is not made accessible to other countries, except in certain circumstances. Users' personal data may be made available to recipients located abroad. Personal data is only transferred abroad if the applicable legal conditions are met. Service providers abroad are required to respect data protection to the same extent as the Company.
If you transmit data to us, you are deemed to consent to these data transfers. You can request additional information by sending us an email: info@docadom.ch.
We only transmit your personal data, including medical information, to external third parties if authorized or required by law, or if you have given your consent during your treatment.
Your data is transmitted to your health insurance, accident insurance, or disability insurance for the settlement of services provided, in accordance with legal provisions.
Cantonal and national authorities, such as the cantonal medical service or health departments, receive your data in compliance with legal reporting obligations.
Optional: If necessary, required patient and billing information is transmitted to the collection agency for debt payment.
Subject to your medical treatment and your consent, data may be transmitted on an ad hoc basis to other authorized parties, such as laboratories or other physicians.
Application-related services:
Usage analysis
We collect information about your activity on our services and how you use them (e.g., date and time of connection, functions used, clicks and pages presented to you) as well as how you interact with other users, through Segment. Segment is a data aggregation tool used to capture data on how users interact with the product.
Usage data and other types of data specified in the service's privacy policy are processed. The place of processing is located in the United States. By continuing to browse our Application, you declare that you accept the transfer of this data.
Monitoring of this Application
These types of services allow this Application to monitor the use and behavior of its components so that its performance, operation, maintenance, and troubleshooting can be improved. Which Personal Data is processed depends on the characteristics and mode of implementation of these services, whose function is to filter the activities of this Application. DOCADOM uses Sentry for this purpose. Sentry is an error and crash monitoring service that helps discover, triage, and prioritize errors in real time. Sentry processes various types of Data as indicated in the service's privacy policy. The data are processed in the United States.
Push notifications
This Application may send push notifications to the User to achieve the purposes outlined in this privacy policy.
In most cases, it is possible to opt-out of receiving push notifications by checking the device settings, such as notification settings for mobile phones, and then changing these settings for this Application, some, or all apps on that particular device. The User should be aware that corporate disabling of push notifications could have a negative effect on the use of this Application, particularly when a medical consultation is requested.
The Application uses Wonderpush. Wonderpush is a service designed to send push notifications to mobile applications and websites. Different types of Data indicated in the service's privacy policy are processed.
The place of data processing is in France.

Platform services and hosting
These services are designed to host and run the key components of this Application, thereby enabling the provision of this Application from a unified platform. This type of platform provides DOCADOM with a wide range of tools, such as analytics, user registration, comment publishing, database management, e-commerce, and payment processing – which involve the collection and handling of Personal Data.
Some of these services operate through geographically dispersed servers, making it difficult to determine the actual location where the personal data is stored.
DOCADOM makes its application available on the Apple App Store (Apple Inc.), a platform for the distribution of mobile applications provided by Apple Inc. Due to its distribution through this app store, Apple collects basic analysis and provides reporting features that allow DOCADOM to view usage analysis data and measure the performance of this Application. Much of this information is processed on an opt-in consent basis. Users can block this analysis feature directly through their device settings. More information on how to manage analytical settings can be found on this page. Usage data is processed. The place of processing is the United States. Privacy Policy: https://www.apple.com/legal/privacy/ DOCADOM is distributed on Google Play Store (Google Ireland Limited), a platform for the distribution of mobile applications provided by Google Ireland Limited. Due to its distribution through this app store, Google collects usage and diagnostic data and shares aggregated information with DOCADOM. Much of this information is processed on an opt-in basis. The website www.docadom.ch may contain interactive buttons called "social media plugins" that allow connection with social network servers such as Facebook, Twitter, Instagram, etc. When you click on one of these buttons, you consent to certain necessary data, such as your IP address and your browsing activities on the website, being transmitted to the operator of the social network concerned. 6. Data retention:
User data is deleted as soon as it is no longer necessary to perform the service offered by DOCADOM. The duration may vary depending on the type of data concerned and applicable legal requirements.
In principle, your personal data is kept for a period of 2 months. If we collect your IP address, it is only recorded for the duration of your use of the website and is then immediately deleted or made anonymous by truncation.
Regarding personal data, this is collected as part of the execution of the contractual relationship between DOCADOM and the User. This data is kept for the duration of the contractual relationship, as long as a User account is active, and is then archived for the legal retention period.
Data collected on the basis of the User's consent is kept until the User revokes their consent.
Personal data collected for the legitimate interests of the Company (market research, for legal purposes, or to improve services) is kept for as long as necessary to achieve these objectives.
Data used for research or statistical analysis purposes is exclusively kept in an anonymized form, which does not allow for the identification of Patients.
The Company may also be required to retain the User's personal data for a longer period if this is necessary to satisfy a legal obligation (e.g., accounting rules or tax law), by order of an authority, or in the context of a procedure. Certain information relating in particular to the contractual relationship must be kept for at least 10 years and certain data relating to healthcare services for at least 20 years.
The retention periods for personal data are solely determined by the Company in its capacity as Data Controller. In the context of processing carried out as a Processor, the Company acts solely on the instructions of the Data Controllers and does not determine the retention period itself. For any questions regarding the retention period of Personal Data for which DOCADOM acts as a Processor, you are recommended to contact your Doctor, the Data Controller, directly. Given the legal archiving obligations imposed on Healthcare Professionals, they may retain the personal data of Users on their own tools for longer periods than those indicated above, in order to ensure medical follow-up and optimal care for Patients.
7. Right of Access, Deletion and Rectification
You may at any time request information about the data we collect about you (right of access). To do this, you must send us a request for information accompanied by a document confirming your identity by E-Mail to the address indicated below.
You also have the possibility to request at any time the deletion or rectification of your data. You also, of course, have the right to revoke at any time your consent to the use or processing of your personal data for the future. On these matters, please write to us by E-Mail at the following address: info@docadom.ch.
Stored data that is no longer necessary to achieve the stated purpose will be deleted.
Regarding the deletion of data, it should be noted that we are subject to legal provisions which require certain data to be kept and that we are therefore obliged to comply with them. If you wish to delete data subject to this retention obligation, we will lock this data in our system and use it only in connection with the legal retention obligations. This data will be deleted following the end of the retention period in accordance with your request.
8. Data Security
We – or our third-party IT service providers – will keep your data secure and will therefore take all necessary measures to protect it from loss, unauthorized access, misuse, or other risks. Our employees and contractual partners who have access to your data are subject to a contractual confidentiality obligation and must comply with legal provisions regarding data protection. In certain cases, it may be necessary for us to forward your requests to our affiliated companies. In these cases, too, your data is treated with strict confidentiality. The Company cannot be held liable for any potential failures of third-party providers. Any potential claims must be directed directly against them, to the exclusion of any claims against the Company.

We use Cookies in order to facilitate the use of our website.
Cookies are small files which, on DOCADOM, only contain information related to your browsing preferences and in no case sensitive information.
These Cookies are necessary for the proper functioning of our website. The information contained in Cookies notably allows an improvement of your navigation on our website and promotes optimal user comfort.

11. Acceptance of data processing
By checking "validate", I confirm that I consent to the processing of my personal and sensitive data, to its access by DOCADOM SA and by the physician, as well as to its transmission to third parties in accordance with this Data Protection Declaration.
I also consent to some of my data being used in a strictly anonymized form for statistical analysis, scientific research, or service improvement purposes. Under no circumstances will nominative data allowing my direct identification be used for these purposes without my prior written consent. I can withdraw this consent at any time by contacting info@docadom.ch, without this affecting my access to medical services.
I further consent to mutual contact between DOCADOM, the physicians, and myself as a patient via the Application. DOCADOM transmits patient information exclusively through secured communication channels. I accept that communication may take place via the DOCADOM Application and/or, when necessary, by unencrypted email or SMS, being informed of the risks associated with these modes of communication.
Finally, I acknowledge that the Federal Health Insurance Act (KVG/LAMal) provides that patients shall receive a copy of DOCADOM's invoice.
